Why are so many SSDI claims denied?

It is true that over 50% of Social Security Disability claims made are initially denied?  The most common reason is that the application forms were not properly filled out or even completed.  Another reason is that the applicant did not supply recent medical records to substantiate their current condition.  To be sure that you have the best chance of getting your claim approved, it is always wise to consult with us at Tri-State Disability Advocates.


Am I eligible for benefits if I am not permanently disabled?

Yes, but your disability must be expected to impair your ability to sustain full time employment for 12 consecutive months.  It is also possible to be approved for benefits for a period of disability even after you have recovered and returned to work.  This past period of disability is referred to as a “closed period”.

I have very little income. How can I afford representation?

You pay nothing unless your disability claim is approved AND you receive back pay.  The amount your representative is paid is established by the Social Security Administration and is only paid if you are approved and you will receive back pay.

What types of disabilities will Social Security Disability pay for?

Almost any medically diagnosed mental or physical disability could qualify for SSDI benefits.  The determining factor is not necessarily the type of condition but how much it impairs your ability to sustain full time employment.  Some people who have cancer, AIDS or severe back injuries may be approved but others, with the same conditions but a different work skill or occupation, may not.

I provided a letter from my doctor saying I couldn't work but was refused. Why?

Many doctors do not understand the documentation that is necessary to provide the SSA for your claim to be accepted.  A letter from your doctor would never be sufficient without full documentation of your tests, diagnosis and treatment visits.  Another reason could be your medical records are not current enough.  Medical records from several years ago will not be acceptable even if you still suffer from the same condition.
